Alec Baldwin Wants Rust Prosecutor Dismissed Because Of Political Affiliation

Alec Baldwin's legal team is now attempting to get prosecutor, Andrea Reeb, tossed from the case for being a New Mexico state representative.

Since formal charges were pressed against Alec Baldwin in the wrongful death of Rust cinematographer Halyna Hutchins, the actor and his defense team have been preparing their case for Baldwin’s innocence. There are some major life-changing charges filed against the actor with a prison sentence looming over him for the negligence carried out on the film’s set. Now, Alec Baldwin’s legal team is striking back against Andrea Reeb, the special prosecutor brought in for the case, as Reeb also serves New Mexico as a state representative.

According to Insider, Alec Baldwin’s lawyers filed their claim asking the judge to disqualify the prosecutor from the case, as they believe that her involvement on the team would be “unconstitutional” due to the political position she already holds. Driving their point home, the attorneys referenced New Mexico’s constitution which says that a state lawmaker is not allowed to carry out their powers in the judicial or executive branch while they’re sworn into the legislative branch. In their filing, the team went after Representative Reeb, writing that because she was already holding a spot in the state’s legislative branch, she should be unable to join the prosecution on the case, referring to the move as “unconstitutional.”

Striking back against Alec Baldwin and his lawyers’ motion to remove the prosecutor, Heather Brewer, a spokesperson for the First Judicial District Attorney’s Office said that the defendant and his attorneys were able to “use whatever tactics” they wanted to try and plead their case. Brewer went on to say that the prosecution believes that the victim was senselessly killed due to a “reckless disregard for safety” on the set of Rust. She added that both the district attorney and the special prosecutor won’t allow what they see as a distraction to pull them away from pouring over the evidence to ensure “that justice is served.”

To refresh your memory on how we got to Alec Baldwin and his representation arguing over New Mexico’s choice of a prosecutor, tragedy struck on the set of Western feature Rust when a gun holding a live round was fired, almost immediately killing Hutchins at point blank range. Since the unbelievable event happened in October 2021, those involved in the film have been under the microscope of the FBI who have been diligently investigating the crime scene. Although it was ruled as an accident, the film’s armorer Hannah Gutierrez-Reed and Alec Baldwin, the latter of whom fired the gun, were both charged with manslaughter and face up to five years in jail if they’re convicted. 

The charges are very serious ones and it’s worth noting that Alec Baldwin initially claimed that he was unaware that the weapon was loaded with real ammunition and that his finger never engaged with the trigger. However, following their investigation, the FBI revealed that the weapon couldn’t have gone off without the trigger being pulled, calling the actor on his bluff. In a further push to avoid what would be a lengthy prison sentence, it makes sense why Alec Baldwin’s defense team is doing everything in their power to poke holes in the prosecution, including calling into question the legality of the special prosecutor.
